세입자가 이사갈때 빌린 집이나 사무실에 남아있는 쓰레기를 무심코 방치했다간 자칫 손해배상 책임까지 질 수 있다는 판결이 나왔다.
서울지법 민사9부(재판장 최춘근부장판사)는 21일 사무실을 임차했던 G사가보증금을 돌려달라며 건물주 김모씨를 상대로 낸 임대차보증금 청구소송에서"피고는 원고가 쓰레기를 방치한데 따른 손해배상금 46만원을 공제하고 나머지 보증금 5백54만원만 돌려주라"며 원고 일부승소 판결을 내렸다.
재판부는 판결문에서 "임대차계약이 끝났을 경우 임대인에게는 그동안 썼던 집이나 사무실 시설에 대한 원상회복 의무가 있는 만큼 쓰레기를 방치했다면 처리비용만큼 손해배상을 해줘야 마땅하다"고 밝혔다.
재판부 관계자는 "쓰레기 방치문제를 둘러싼 임대인과 세입자간 분쟁은 대부분 소액이어서 조정으로 해결이 가능하지만 최근들어 폐가전제품류의 처리 비용이 높아지는 등 분쟁의 소지가 늘어나고 있는 만큼 세입자는 유의할 필요가 있다"고 말했다.
