기존대출 보증분은 채무상환시까지유지 올 하반기부터 한빛.조흥.신한.주 택.기업.산업등 6개 은행과 거래하는 고객들은 대출시 1천만원 내외의 한도까지만 연대보증인을 세울 수 있게 된다. 나머지 은행들도 내년 상반기중 이같은 내용의 연대보증제 개선안을 시행하며 연대보증 한도는 건당 1천만원 내외에서 각 은행이 자율적으로 결정하게 된다. 기존 대출에 대한 보증은 채무상환시까지 유지되며 대출금 일부에 대해 서만 보증을 서는 부분 연대보증제도와 보증을 설 수 있는 총액을 설정 하는보증총액한도제가 병행 실시된다.
은행연합회는 27일 공청회 등을 통한 여론수렴을 거쳐 이같은 내용의 연대보증제도 개선방안을 확정, 발표했다. 방안에 따르면 연대보증제를 기본적으로 폐지하되 서민 및 일반 가계의 신용경색현상을 예방하기 위해 각 은행이 건별로 1천만원내외의 한도내 에서 제한적으로 보증제도를 유지하기로 했다. 이와함께 채무자의 신용한도를 초과하는 금액에 대해서만 보증을 서는 ' 부분연대보증제도'가 병행 실시되며 내년 하반기부터는 은행이 보증인의 순재산(자산-부채) 및 연간소득, 직업별 신용등급 등을 감안해 보증총액 한도를 정하는 '보증총액한도제'도 2000년 하반기부터 시행된다. 보증총액한도제가 시행되면 보증금액에 따라 본인이 신용대출을 받을 수 있는 한도가 그만큼 축소되기 때문에 유의해야 한다.
기존 연대보증은 채무자가 대출을 상환해 연대보증 채무가 자연 해소될 때까지유지된다. 이와함께 각 은행은 오는 10월부터 채무자의 신용이 악화돼 더이상 거 래를 할수 없게 될 경우 이를 보증인에게 반드시 통지해야 하며 보증시 채무자의 부채현황및 신용불량정보 등 신용상태를 역시 보증인에게 설명해야 한다.
이번 개선안은 은행 대출에 대한 개인의 보증시에 적용되며 법인 여신의 경우지배주주나 과점주주 등 실질적인 소유관계에 있는 자는 금액에 제한없이 연대보증을 설 수 있다. 시행시기는 은행이 자율적으로 정하되 신용평가시스템이 구축되고 전산 프로그램이 개발된 한빛.조흥.신한.주택.기업.산업 등 6개 은행은 올해안에 먼저 실시하고 나머지 은행들도 내년 6월말까지 시행할 예정이다. 은행연합회는 연대보증제도 개선을 위해 신용정보 인프라의 구축이 시 급하다고 판단, 금융기관 거래 정보외에 세금체납 정보 등 개인의 신용평 가에 필요한 각종정보를 연합회에 집중시켜주도록 정부에 건의할 예정이다.
은행연합회 장성부(장성부) 상무는 '이번 제도개선으로 무분별한연대보증으로인한 서민들의 피해가 줄어들 것으로 기대하며 개인들도 기업들과 같이주거래은행(Key Bank)을 정해 신용을 축적하는 등 신용을 철저히 관리해야 할 것'이라고 말했다.
