지난 27일 서울행정법원 행정4부는 한탄강댐 건설 기본계획 고시를 취소해 달라며 철원지역 주민 150여명이 국토해양부 장관을 상대로 낸 소송에서 정부의 손을 들어줬다. 재판부는 댐 건설로 인한 자연환경이나 문화재 보호의 일반적인 필요성은 인정하지만 한탄강댐은 미래 발생 가능한 피해 예측에 따른 대책으로의 필요성을 부인할 수 없다고 밝혔다.
댐 건설로 인한 폐해를 주장하는 주민들의 주장을 인정하면서도 댐 건설 자체를 뒤집을 만한 이유로 삼기 어렵다고 판단한 결과로 보인다. 그러나 댐 건설에 반대해 온 철원지역 주민들은 재판부가 댐 건설의 타당성보다는 절차적인 하자만 검토해 판결을내렸다고 강하게 반발했다. 이날 소송을 제기한 원고측은 서울 세종로 정부종합청사 앞에서 기자회견을 갖고 법원의 1심 판결에 불복, 항소하겠다는 뜻을 분명히 밝혔다.
법정싸움에서도 양측이 접점을 찾기는커녕 첨예하게 대립하는 양상을 보인 것이다. 따라서 한탄강댐 논란은 앞으로 2심, 대법원까지 이어질 것으로 예상된다. 앞으로도 1년 이상 법정 다툼이 불가피해진 것이다. 이렇게 되면 한탄강댐 건설 논란은 10년을 훌쩍 넘기게 된다. 이미 엄청난 혼란과 갈등을 겪었거니와 앞으로도 지역간, 혹은 인접 자치단체 간의 엄청난 소모적인 갈등과 혼란이 이어질 것이라는 이야기다.
9년 여의 진통을 겪고도 결론을 내지 못한 한탄강댐 건설은 사업 자체의 당위성과 절차적 정당성을 결여한 채 무리하게 국책사업이 얼마나 큰 갈등과 혼란을 야기하는지를 극명하게 드러낸 사례다. 한탄강댐은 이미 엄청난 갈등과 비용을 지불하고도 한걸음도 나아가지 못하고 있다.
더욱이 사업초기부터 각종 비리와 불·탈법의혹이 제기돼 감사원의 감사까지 받았다. 그 결과 한탄강댐 건설과정이 비리와 부실·불법으로 얼룩져 있음이 드러나 댐 건설이 재검토돼야 한다는 지적을 받았다. 여기에 지난해 10월 2∼4일 평양에서 열린 남북정상회담에서 한강하구 준설과 임진강 수해방지 사업에 대한 합의가 이뤄져 새로운 변수가 되기도 했다.
남북이 합의를 이행한다면 하구준설을 통해 임진강 수위를 1m 정도 낮출 수 있고 수방대책으로 추진되는 한탄강댐의 재검토 사유가 충분했기때문이다. 남북관계 개선 여부가 한탄강댐 문제를 푸는 데 단서가 될 수 있다는 것이다. 그러나 원고측은 불복을 선언했고, 정부는 항소와는 관계없이 공사 강행을 천명하고 있다. 한탄강댐 논란은 부실하게 추진되는 국책사업이 얼마나 큰 희생과 비용을 요구하는지 살아 있는 교훈이 되고 있다.
