서울행정법원 한탄강댐 축소조정 권고안에 대한 환경운동연합 논평

(서울=뉴스와이어) 오늘(25일) 서울행정법원 제4부는 철원, 연천, 포천 지역주민이 건설교통부와 수자원공사를 상대로 낸 한탄강댐고시 취소소송에서 판결을 미루고 축소조정(2.7억톤->1.3억톤) 권고안을 내 놓았다. 재판부는 이번 축소조정 권고 안의 배경을 강의 상·하류 주민의 갈등, 반대측과 수자원공사의 의견 대립, 재판부 내에서 댐의 적정성, 안정성, 경제성을 검토한 결과라고 했다.

하지만 이번 권고안은 그 동안 댐 추진측에서 내세웠던 일방적인 논리와 증거들을 제척하고 정부가 주장했던 규모의 절반 이하를 조정의 기준으로 내세운 것이어서, 댐 건설 계획의 타당성을 사실상 부정한 것이라고 할 수 있다. 국책사업의 체면을 고려해서 조정안을 낸 것일 뿐, 전후 사정을 고려할 때 댐 계획의 취소처분이나 마찬가지다.

즉, 재판부의 조정안대로 댐을 축소하면 파주문산지역의 홍수조절 방안으로 마련된 한탄강 댐의 효과는 더욱 줄어들어, 임진강 하류 홍수위는 겨우 5cm 정도 조절되는 데 그칠 전망이다. 하지만 댐 건설 예정지의 지형 특성상 댐 길이는 거의 줄어들지 않아서 건설비에는 별 영향이 없을 것으로 보인다.

또한 재판부가 권고안에서 함께 밝힌 바, 가까운 장래에 천변저류지가 확대될 예정이고, 제방의보강과 증고가 있었고, 남북관계의 진전에 따라 추가 홍수 대책 마련이 가능할 것이라는 의견도 의미심장하다. 재판부로서는 댐의 효용성에 의문을 갖고 있으며, 별도의 홍수조절 수단에 관심을 가지고 있다는 것이다.

그간 ‘건설을 위한 건설’을 명분으로 내세웠던 정부로서는 이제 더 이상 할 말이 없게 됐다. 애초 주장했던 홍수조절 효과의 미비는 이미 2005년 감사원 감사에서도 확인됐고, 지역 경제, 문화, 생태적 측면에서 그 어느 것 하나도 타당성을 입증하지 못했다. 논쟁을 할수록 부정확한 자료와 허술한 논리는 끊임없이 드러나고 있다.

이제라도 추진측은 현명하고 합리적 판단을 내려야 한다. 주민들의 반대, 재판부의 우려 그리고 진실과 역사를 거스르면서까지 억지를 부려서는 안 된다. 마침 철원 연천 포천 댐반대 대책위에서는 댐 이외의 모든 홍수조절방안에 대해 협조할 뜻을 밝히고 있다. 물러설 때를 정확히 찾지 못하면 추해진다. 추진측은 이제 헛된 꿈을 접어야 한다.
