무책임한 관료들 보따리 싸게 된다

3급 이상 고위공무원 등 공직자들의 정책실패에 대한 시민사회의 책임 추궁이 강화될 것으로 전망된다.

최근 서민들의 삶을 피폐화한 바다이야기 등 사행성 도박게임을 규제하지 못한 문화관광부 등 관련 부처에 언론과 시민사회의 비판이 거셌지만, 국무총리와 문광부 장관 사과 이외에 정책 실패에 대해 실질적인 책임을 진 고위공무원들은 찾아보기 힘들다.

1997년 IMF나 2003년 카드대란 때도 해당부처 장·차관들이 사과와 사퇴는 있었지만, 가장 많은 정보와 결정 권한을 쥐고 있는 관료들은 형사처벌은 물론 직무유기·직권남용을 해도 책임을 지지 않는 것이 현실이다.

국가공무원법 83조 2항은 ‘징계의결의 요구는 징계사유가 발생한 날로부터 2년(금품 및 향응수수, 공금의 횡령유용의 경우에는 3년)을 경과한 때에는 이를 행하지 못한다’고 규정하고 있어 공무원들의 정책실패를 지속적으로 감시하고 책임을 묻는 데 한계가 있었다.

■ 실패는 있어도 책임은 없다?

이에 참여연대 맑은사회만들기본부는 11일 서울 안국동 달개비에서‘관료 감시운동’을 시작하는 발족식을 열고, 정부 부처 장차관과 고위공무원단(1~3급)과 팀장급(4급) 공직자들에 대한 정책 책임을 추궁할 방침을 밝혔다.

정치인들은 선거로 심판을 받고 장·차관 들은 자리에서 물러나는 것으로 정책 실패에 대한 책임을 지지만, 주요 국가정책과 예산을 결정하고 집행하는 관료들에게는 실패는 있어도 책임은 없는 문제를 제기한 것.

다만 참여연대는“관료 감시운동은 관료를 비난하고 흠집내고자 것이 아닌 묵묵히 자신의 직무를 수행하는 대다수 관료들이 정당한 평가를 받고 마음 놓고 일할 수 있는 풍토를 조성하는 사회운동이다”고 설명했다.

김기식 참여연대 사무처장은“반부패를 위한 참여연대의 10년 동안의 성과를 기반으로 관료 개인들을 실명 감시해 정책 실패를 추궁하고, 공직사회의 책임의식을 높이는 사회운동이 될 것이다”고 말했다.

■ 예산낭비 등 피해, 시민들이 감시

참여연대는 우선 올해 국민의 삶에 직접적인 피해를 주었거나 예산낭비가 심각했던 정책사안을 대상으로 ‘관료 감시운동’을 시작한다.

이 단체는‘국민의 삶의 직접적인 영향을 미치는 사회경제정책’으로 △무분별한 신용카드 감독정책 완화로 인한 카드대란 발생 △론스타의 외환은행 인수자격 부실심사 문제 △삼성카드·현대캐피탈 등의 금산법위반 시정조치 미실시 △한화그룹의 대한생명 인수자격 부실심사 문제 △생명보험사 상장방안에 대한 업계의 편향적 대응을 들었다.

‘대규모 예산낭비가 예견되는 대형국책 사업’으로는 △새만금 갯벌 매립사업 △한탄강 댐 건설 재추친 △주한미군기지 이전협상 △차세대전투기 F-15K 도입 등을 선정했고, ‘향후 국민의 삶에 막대한 피해를 줄 가능성이 높은 정책’으로는 △한미FTA △인터넷로또 허용 등을 선정했다.

또한, 참여연대는 ‘정책실패 사전경보’ 운동을 통해 정책 실패했을 경우, 국민생활에 큰 피해와 막대한 예산낭비가 우려되는 정책에 대해 정책배심원단을 구성해 감시활동을 펼친다. 또한 시민 정책배심원단과 누리꾼들이 참여하는 커뮤니티를 통해 시민들의 참여를 유도할 방침이다.

앞으로 참여연대는 ‘선출되지 않은 권력’인 관료에 대한 민주적 통제와 함께 공직사회의 무책임과 무사안일을 타파해 국민을 위한 정책수립 국가자원의 올바른 분배를 이끌어 낼 것이라고 밝혔다.

Open dialogue and exchange of ideas are the first steps in raising awareness and stopping the cycle of abuse.
