내용 | 환경법률센타에 들어와서 환경사건 중에서는 첫 번째 판결문을 받아보았다. 페이지마다 구멍이 뚫려있고 첫 장의 주문에는‘국방·군사시설사업 실시계획 승인처분은 무효임을 확인한다’라고 명시되어 있는 판결문이었다.
너무나 당연한 무효사유라고 생각해 왔지만 막상 무효판결이 나자 도창리 주민들의 반응과 마찬가지로 무효주장을 해오던 변호사로서도 처음에는 믿기지 않아 한동안 자리에서 일어나지 못하였다.
보통 행정사건은 민사사건에 비해 그 수가 매우 적다. 그리고 행정사건의 인용율도 다른 민사사건에 비해 매우 낮다고 알려져 있다.
특히 군사지역에 살고 있는 철원 도창리 주민들이 국방부장관을 상대로 한 소송이었고 상대방 소송수행자가 국가안보상 필요한 군사 훈련장이라는 주장을 하였으므로 지역주민들의 님비현상으로 비쳐질 소지가 전혀 없는 것도 아니었다.
그러나 국방부장관의 처분이 법의 절차를 거치지 아니하였고, 지역주민들과 충분한 협의를 거치지 않은 채 군사시설을 설치하였고, 심지어 주민들이 식수원으로 사용하는 하천상류 인근 부지에 포격 피탄지를 조성하면서 단순한 혐오시설이 아닌 위험시설을 주민들에게 강요하는 그야말로 군사독재시대에서나 볼 수 있었던 강압적 사격장 설치임이 분명하였다.
그리고 법원은 그동안 환경영향평가법에 버젓이 있었던 사전공사시행금지규정(동법 제28조)이나 일정한 규모 이상(군사시설설치 부지면적이 33만 제곱미터이상)의 경우 반드시 승인처분이 있기 전에 환경영향평가를 거치도록 되어 있는 법령규정들을 위반한 경우에 형식적 절차규정의 위반은 무효사유가 아니라고 하거나 사후에 환경영향평가를 거치었다면 그 하자가 치유된다는 취지로 판시하는 등 실제 위 환경영향평가법의 제정취지에 맞지 않게 운용해온 것이 사실이다.
그런데 이번 서울행정법원에서는 그동안의 우려를 불식시키며 ‘사업자가 사전에 환경영향평가를 전혀 실시하지 아니한 채 사업계획이 수립·실시된 이 사건에 있어서는, 사전에 환경영향평가에 주민들의 의견들을 수렴하고 환경부장관과의 협의내용을 사업계획에 반영시키는 것 자체가 원천적으로 봉쇄되는 것이므로, 인근주민들의 직접적이고 개별적인 이익이 근본적으로 침해되었다고 보아야 할 뿐만 아니라 환경파괴를 미연에 방지하기 위하여 도입된 환경영향평가법의 입법취지 자체가 몰각되는 결과를 초래하였다고 할 것이다’라고 하여 ‘피고가 환경영향평가를 실시하지 않은 것은 단순히 취소사유에 그치는 것이 아니라 그 하자가 중대하고도 명백하여 무효사유에 해당한다고 할 것이다’라고 처음으로 판시한 것이다.
따라서 위 도창리 판결로 인하여 환경영향평가법의 각 규정들은 새롭게 생명력을 얻으며 여타의 사업 등에서 환경영향평가를 거치어야 함에도 이를 무시하면 언제든지 무효로 될 수 있음을 확인받은 것이다.
이는 환경영향평가법이 강력한 환경규제법으로서의 제 역할을 할 수 있는 굳건한 토대를 만들었다는 점에서 그 의의가 매우 크다고 본다.
사실 이번 판결의 결과에는 주민들의 역할이 매우 큰 동력으로 작용했다. 아무리 사소한 것이라도 직접 챙기고 증거자료를 만들어 왔던 주민들 중 한분은 “우리는 군사 훈련장을 반대하는 것이 아닙니다.
굳이 군사지역에서 그나마 유일한 휴식처인 우리 마을 뒷산에 사격장이 들어와야 됩니까? 우리 아이들은 어디에서 뛰어놀며 사방이 폭격장으로 둘러싸여서 어디 불안해서 살수 있겠습니까?
정말 분통터지는 노릇은 피탄지를 모두 설치해 놓고서는 그 인근에 식수원으로 쓰이는 상수원이 있었다는 것을 국방부놈들도 몰랐고 철원군청놈들도 몰랐다는 것입니다. 이게 말이됩니까?
우리 아이들에게 폭탄파편에 쓸린 물을 어떻게 먹으라고 합니까?”라고 성토하였고 이러한 주민들의 한맺힌 목소리들이 재판부에까지 전달되었다고 믿는다.
다만 주민들의 분노에 찬 절규를 들으면서 내가 한일도 아님에도 가슴 한구석이 뜨끔하였다. 법리를 떠나서 군사지역이라는 이유로 어떻게 보면 그 곳에 사는 주민들은 사람취급도 제대로 받지 못했던 것이다.
인권의 사각지대에서 살고 있는 분들이 아직도 참 많다라는 생각에 소송을 법령위반으로만 접근하려 했던 자신이 부끄러워 진 것이다.
도창리 주민들의 싸움은 아직 끝나지 않았다. 위 사건에 대하여 피고가 항소할 것이 분명하기 때문이다. 그러나 지금은 도창리 주민들과 똑같은 희망을 가지고 공동의 싸움을 벌일 수 있을 것 같다.
아직도 피탄지 부지로 파헤쳐진 그곳이 원상복구되고 그곳에서 꽃이 피고 동물들이 뛰어놀 때쯤 꼭 한번 가보고 싶은 소망이 생겼기 때문이다. 그리고 도창리의 마을 뒷산은 이제 예전과 달라질 것이다. 주민의 힘으로 국민에 반하는 행정을 바로잡는 새로운 역사를 만들어 내는 곳으로 다시 태어나야 하기 때문이다.
