아름다운 한탄강에 1조 956억원을 들여서 거대한 콘크리트 덩어리를 쌓겠다는 한탄강 댐 건설계획은 수해원인에 대한 분석보다 대책인 댐 설계를 먼저 마치는 등 진실과 타당성이 없는 사업으로, 저의 고향인 인제 내린천댐 건설 반대 주민운동과 비슷한 점이 참으로 많다고 보여 집니다. 그리고 지류에 인위적으로 대규모 수몰지를 만들어 본류의 홍수를 조절하겠다는 한탄강 댐은 내용적으로나 절차적으로 중대한 하자가 있어 비례의 원칙에 반하고, 경제성과 수익성도 없기에 백지화 하는 것이 순리라고 생각합니다.

이러한 한탄강 댐 계획의 무모성은 이미 2005년 5월 감사원 감사를 통해 여실히 드러난 바 있습니다. 감사원은 댐의 홍수조절능력과 경제적 편익이 부풀려졌고 정당한 절차를 위반하였다고 지적한 것입니다.

한탄강에 댐을 지으려는 목적은 무엇입니까. 90년대 후반 임진강에 홍수가 나 큰 피해를 보았기 때문입니다. 치수대책으로는 여러 가지가 있으나, 그 중 대형 댐은 순기능보다 역기능이 많은 최후의 수단이므로 치수정책에 있어, 댐 이외의 환경과 경제를 살리는 다양한 대안을 먼저 생각하는 것이 국가적으로 더 바람직한 판단일 것입니다.

그러나, 그동안 피고는 댐의 유무와는 아무런「인과관계」도 없는 하천관리부실 및 임진강 하구의 퇴적물로 인한 유수단면적 부족 등에 의한 파주 문산의 수해를 마치 지류(支流)인 한탄강에 댐이 없어서 발생한 것처럼 호도하여 왔습니다. 또한 대안인 제방의 길이와 사업비를 과다 산정하였으며, 댐의 홍수조절 효과를 부풀리기도 하였습니다. 이처럼 한탄강 댐 계획의 이면에는 정책문제설정의 오류와 절차적 부당성 그리고 사회적, 경제적 타당성 부족 등이 혼재되어 있습니다.

기실 96년, 99년 임진강 대홍수 시 하류인 파주(2,013억원, 22%) 보다 상류지역인 철원· 포천· 연천이 가장 많은 피해(5,301억원, 59%)를 입었으며, 상류에서 하류로 순차적으로 수해가 발생한 것이 아니라 동시에 발생한 사실에서 알 수 있듯이, 그 당시의 수해는 임진강 하류 자체의 구조적인 문제와 수방대책을 잘못한 국가행정에 그 원인이 있다고 보여 집니다.

그 후 파주시는 수방(水防)에 투자와 노력을 아끼지 않았습니다. 파주시는 2000년부터 3년간 무려 4천억원 가량의 예산을 투입해 도시 시스템을 개조하였습니다. 우선 문산읍을 둘러싸고 있는 문산천과 동문천 제방 양쪽 20km 및 경의선 철로 1km 구간의 지반을 3~5m 가량 높이고, 하천의 바닥도 넓혔으며, 문산읍의 배수펌프장을 1곳에서 6곳으로 늘려 배수용량을 분당 총 3,000톤으로 늘렸고, 교량 곳곳에 임진강 본류의 물 흐름을 파악할 수 있도록 CCTV를 설치, 재난안전대책 상황실에서 실시간으로 관찰하는 등 수해예방에 정성을 다 하였습니다.

그러기에 태풍 매미의 내습으로 전국적으로 집중호우가 내린 2003년, 파주시가 수해로 입은 피해는 6억원에 불과했습니다. 또한 2006년 시간당 100mm의 기록적인 집중호우가 내려 일산 신도시가 아수라장이 됐던 12일 오전, 인접 지역인 문산읍에도 7월 12일~13일에 200mm의 폭우가 사정없이 쏟아졌는데도「수해 무풍지대」였습니다. 피해라야 저지대 농경지 일부가 물에 잠겼을 뿐입니다. 1996년 7월말 당시 200mm 가량의 폭우에 시가지 일대 주택가는 물이 허리까지 찰 정도로 잠겼는데 이번에는 괜찮았던 것은 2000년 이후 문산 지역의 둑방을 높이고, 배수시설을 확충하는 등 다각적인 수방대책 덕분이라는 분석입니다.

이러한 ‘사정변경’으로 댐이 없어도 제방과 배수시설로 홍수대비를 잘하면 피해를 막을 수 있으며, 강 하류에 천변저류지의 확충과 제방의 증고 등 알맞은 치수 수단을 덧붙이면 댐 이상의 효과를 낼 수 있다는 원고 측의 주장이 입증된 셈입니다.

최근 파주시는 소방방재청 주관의 2007년 여름철 자연재난 사전대비 업무추진 전국시군구 평가에서 우수기관으로 선정되어 국무총리 상을 받았으며, 오는 5월 25일 제15회 방재의 날에「2007 전국 지자체 대상 재난관리평가」에서 최우수 자치단체로 선정 돼 대통령상을 수상한다고 합니다. 이와 같이 문산 지역의 수방대책이 대부분 완료된 관계로 쓸모없는 이중 투자가 되기 때문에, 댐 예산 1조 956억원은 한탄강의 자연과 문화를 지키고, 상하류가 공생하고 안전하며 합리적인 ‘새로운 임진강 유역 치수대책’을 마련하는 데 써야 할 것입니다.

그리고 무엇보다 풍부한 생물자원을 간직하고 있는 하천생태계의 보고이며, 동북아시아 구석기 유적의 메카인 한탄강에 댐을 짓는 것은 국토해양부의 조직이기를 위해, 길이 후손에게 물려줄 희귀하고 아름다운 자연생태문화재를 파괴하고, 986여명의 포천 · 연천주민들의 정든 고향과 오랜 삶의 터전을 수장시키려는 문명의 야만인 것입니다.

존경하는 재판장님!
저는 우리나라 국민들이 한탄강의 비경을 즐기고 사랑하며 세계적인 자연문화유산으로 영원히 흐를 수 있게 되기를 바라며, 불필요한 한탄강 댐을 둘둘 말아 폐기하는 것이야말로 기술관료사회를 민주화하고 생태적 복지국가로 성장하기 위한 ‘역사적 진통’이라고 생각합니다.

이에 신성한 사법부에서 보다 합리적이고 안전한 대안인 제방증고와 천변저류지의 확대 등으로 한탄강변과 임진강 하류의 모든 사람들이 그들의 소중한 삶과 꿈을 향유하면서, 한국사회가 선진화로 나아갈 수 있는 ‘새로운 새벽’을 열어주시길 간곡히 탄원 드립니다.
