 문화 명령과 토지사유제 http://blog.naver.com/im011ace/140008378146 문화 명령과 토지사유제 - 박창수(성토모 정책국장) 토지사유제 : 문화명령을 훼방 “땅은 인생[인용자: the children of men, 즉 모든 인류]에게 주셨도다”(시115:16)라는 말씀으로 자연법 철학자 존 로크는 하나님이 토지를 모든 인류에게 공동으로 주셨음을 다음과 같이 밝힌 바 있다. “다윗 왕이 시편 115:16에서 말했듯이, 하나님께서 이 땅을 사람들의 자녀들, 곧 인류에게 공동으로 하사하신 것이 명백하다(It is very clear that God, as King David says in Psalm 115:16, has given the earth to the children of men, given it to mankind in common).” 이처럼 하나님이 토지를 모든 인류에게 공동으로 주셨기 때문에, 모든 인류는 평등한 토지권을 가지고 있다. 이 평균 지권(平均 地權)은, 같은 시대에 사는 인류의 평균 지권뿐만 아니라, 현재 세대와 미래 세대 사이의 평균지권도 포함한다. 구약 율법 중에 안식년과 희년의 정기 토지 안식법이 있는데, 만약 정기 토지 안식법을 지키지 않고 안식년과 희년에도 땅을 착취적으로 경작하여 지력이 고갈되면, 미래 세대는 척박한 땅을 물려받을 수밖에 없게 된다. 그런 점에서 정기 토지 안식법에는 현재 세대와 미래 세대 사이의 평균지권을 보장하기 위한 의미도 있음을 알 수 있다. 미래 세대도 현재 세대와 평등한 토지권을 누릴 수 있도록 하는 한계 내에서 현재 세대가 토지를 사용해야 한다는 이런 구약의 가르침은 오늘날 사회과학에서 회자되는 ‘환경적으로 건전하고 지속가능한 개발’(ESSD; Environmentally Sound and Sustainable Development)과 동일한 의미이다. 비록 환경 문제라는 맥락은 아니지만, 헨리 조지 역시 같은 시대에 사는 인류의 평균지권뿐 아니라, 현재 세대와 미래 세대 사이의 모든 인류의 세대간 평균지권을 역설한 바 있다. “몇 명의 개인들이 모여서 다른 개인들이 토지에 대하여 갖고 있는 평등한 권리를 빼앗아 양도하는 것은 정당하게 이루어질 수가 없으며 어떠한 세대도 다음 세대의 권리를 빼앗아 양도할 수 없다.”(헨리 조지가 기초하여 영국 토지 회복 연맹이 1884년에 발표한 선언문). “하나님이 그들[인용자: 모든 인류]에게 복을 주시며 그들에게 이르시되 ... 땅을 정복하라[인용자: 토지에 노동을 투입하여 부(富)를 생산하라].”(창1:28) 창세기의 위 명령은 문화명령(혹은 창조명령, 위임통치명령)이라고 하는데, 이 문화명령을 하나님께 받은 대상은 특정 개인이 아닌 모든 인류이다. 문화명령을 받은 ‘그들’은 모든 인류를 대표하며, 이 명령에서 제외되는 사람은 단 한 명도 없다. 그리고 하나님이 땅을 정복하라고 하신 모든 인류는 같은 시대에 사는 인류뿐만 아니라, 현재 세대와 미래 세대를 포함한 모든 인류이다. 그런데 문화명령에서, ‘땅을 정복하라’는 말씀은, 경제학적으로 표현하면 ‘토지에 노동을 투입하여 부(富)를 생산하라’는 의미이다. 다만 전제는 위에서 언급했듯이 미래세대도 현재세대와 평균지권을 누릴 수 있도록 토지를 보호하면서 토지 사용을 해야 한다는 것이다. 요컨대 하나님은 모든 인류에게 토지에 노동을 투입해서 부를 생산하라는 명령을 주신 것이다. 그런데 오늘날 토지사유제(土地私有制)는 이 하나님의 복된 문화명령을 정면으로 거역한다. 토지사유제 하에서 노동자와 기업가는 아무리 토지에 노동을 투입해서 부를 생산하려고 해도, 지주(地主)가 토지사용을 허락하지 않으면 그것을 실행할 수 없다. 오래전, ‘예수 마을’이라는 농촌공동체를 세우기 위해, 공동체 입지에 좋은 땅을 찾던 한 목사님으로부터 들은 이야기이다. 마침 강원도 어느 시골의 땅을 보았는데, 공동체를 세우기에 매우 좋은 곳이어서, 군청에 그 땅의 소유자를 문의했더니, 군청 직원이 하는 말인즉, 그 땅은 모 재벌의 땅이니 일찌감치 포기하라는 것이었다. 그런데 그 땅은 전혀 기업활동이 이루어지지 않고 있는 땅이었다. 바로 재벌이 땅값 상승을 노리고 투기용으로 보유하고 있는 토지였던 것이다. 땅값 오르기만 기다리며 땅을 놀리고 있는 지주의 전횡을 보호하고, 오히려 그 땅에 농촌공동체를 건설하려고 하는 사람들을 막고 있는 어처구니없는 제도가 바로 토지사유제인 것이다. 라틴 아메리카에서 가장 큰 사회운동으로, 브라질에 MST(Movimento dos trabalhadores ruralis Sem Terra, 땅없는 사람들의 유휴 토지 점거 운동)가 있다. 브라질 인구의 3%미만이 경작 토지의 2/3를 소유하고 있는데, 이들 대지주들은 상파울로같은 대도시에서 사치스런 생활을 하면서, 소유 토지가 너무 커서 불과 40%만 생산활동에 사용하고 나머지 토지의 60%는 놀리고 있는데 반하여, 2500만명이나 되는 땅없는 농민들은 임시직라도 구하기 위해 생존 경쟁을 해야 하는 현실이 MST의 배경이었다. 1985년 가톨릭 교회의 지원(해방신학, 바닥공동체 중심)아래 수백명의 땅없는 농민들이 브라질 남부의 유휴 플랜테이션 농장을 점거하고, 그 땅에서 나가라는 지주와 정부의 위협 명령에도 불구하고 끝까지 ‘안 나가고 버티기’ 투쟁을 하면서 성공적으로 조합을 건설하여, 결국 1987년에 토지권을 획득하였다. 이 사건을 계기로 하여 땅없는 농민들뿐만 아니라 화벨라도스(땅없는 도시 무단거주 빈민)가 참여하면서, 지금까지 25만 가구 이상이 1500만 에이커 이상의 점거토지에 대해 토지권을 획득하였다. 그러나 이것은 쉽게 이루어진 일이 아니었고 많은 사람의 피가 흘려졌다. 지난 10년동안 지주와 경찰에 의해 1,000명 이상의 농민과 지도자들이 살해당했던 것이다. 수많은 도시빈민과 농민들이 땅 한평도 없는 현실, 그리고 극소수 지주가 경작 토지의 2/3라는 엄청난 토지를 소유하고, 그 가운데 60% 토지는 놀리고 있는 현실에서, 이 MST는 비록 토지사유제 하에서는 불법이지만, “땅을 정복하라[토지에 노동을 투입해서 부를 생산하라]”는 하나님의 명령 앞에서는 합법이 되지 않을까? 이처럼 지주의 전횡을 합법적으로 보장하는 토지사유제는, 문화명령에 순종하여 토지에 노동을 투입해서 부를 생산하려고 하고 또 공동체를 세우려고 하는 모든 창조적인 시도들을 가로막고 있다. 이처럼 토지사유제가 존속하는 한, 문화명령은 훼방받을 수밖에 없다. 모든 인류가 문화명령을 온전히 실행하기 위해서는 토지사유제가 철폐되거나 최소한 무력화되어야 한다. 토지사유제와 문화명령은 양립할 수 없는 것이다. 지대조세제의 효과 : 경자유전(耕者有田)화 지가(地價)는 ‘미래의 지대(地代) 수입을 모두 합하여 현재가치화한 것’인데, 만약 지대조세제가 실시되어, 토지소유자가 매년 지대의 거의 전부를 세금으로 납부하여 지주가 지대를 거의 갖지 못하게 되면, 지가는 거의 '0'이 된다. 지가 거의 '0'화는, 마치 미국 서부 개척시대에 광활한 토지가 개척민을 기다리듯이, 모든 토지가 만인에게 그 사용기회를 개방하게 된다는 의미이다. 지대조세제 하에서, 토지소유자는 지대세를 정부에 납부하고 토지사용자는 지대를 토지소유자에게 지불하므로, 토지비용에 관한 한 토지를 소유하면서 사용하건 임차하여 사용하건 양자의 금전적 손익은 동일하다. 그러나 토지임차인은 토지소유자와의 계약을 통해서만 토지를 사용할 수 있기 때문에 토지 사용의 보장이라는 점에서 토지를 직접 소유하는 것보다 불리하고, 지가가 거의 '0'이기 때문에 토지를 매입하기 위해 필요한 추가 비용은 아주 조금이므로, 토지 사용자는 가급적 토지소유권을 취득하려고 하게 된다. 한편 지대조세제 하에서 토지소유자는, 유휴 토지의 경우 매년 지대세를 납부해야 하므로 땅을 놀리면서 소유하는 만큼 손해를 보게 된다. 그래서 사용하지 않는 유휴 토지는 처분하게 되므로 토지의 유량공급도 원활하게 된다. 이러한 이유로 토지소유자와 실수요자가 일치하는 경향이 나타난다. 이처럼 지대조세제에서는 토지소유자와 실수요자가 일치하는, 농지에서의 경자유전(耕者有田)의 원칙이 상공용지를 포함한 모든 토지에까지 자연스럽게 확대된다. 그렇다면 토지의 분배상태는 상당히 평등해질 것이다. 토지의 소유자와 사용자가 일치한다고 해서 토지소유가 완전 균등하게 되는 것은 물론 아니다. 토지 사용 목적에 따라 필요한 토지의 양과 질이 다르기 때문이다. 그러나 실수요자와 소유자가 일치하게 되면 적어도 현재처럼 투기목적을 겸한 토지의 과다 보유는 분명히 시정될 것이므로 토지배분의 평등화 효과는 상당히 나타날 것이다. 하나님은 모든 인류에게 땅을 공동으로 주시고 ‘땅을 정복하라’, 즉 ‘토지에 노동을 투입해서 부(富)를 생산하라’는 복된 문화명령을 주셨지만 토지사유제는 이것을 정면으로 거역하고 있다. 그러나 지대조세제가 실시되면, 토지에 노동을 투입해서 부를 생산하기 원하는 토지 실수요자가 토지를 소유하게 되는 경자유전화를 통해, 모든 인류는 문화명령을 훨씬 더 잘 지킬 수 있게 될 것이다. 지대조세제는 문화명령을 훼방하고 있는 토지사유제를 무력화시켜 인류의 문화명령 수행을 돕는, 매우 실제적이고 성경적인 대안인 것이다. 주: “지대조세제의 효과: 경자유전(耕者有田)화”의 대부분은 [김윤상, 『토지정책론』, 한국학술정보(주), 2002.]에서 인용한 것이다.  ijblplpyb: Individuals with dried-out skin need to have plenty PMS and improve mood.
